FOR CONSUMERS

Terms and conditions for private customers

Updated: 12 October 2026

These terms apply to consumers booking digital courses, online lessons or VIP programmes through the website or a personal offer. Business customers are covered by the terms for companies.

English version for ease of understanding. The agreed contractual language is German; mandatory consumer rights remain applicable.

§ 1 Provider and scope

(1) The provider and contracting party is Lernes Ltd, trading as KlinikDeutsch, Filias 9, 8220 Paphos, Cyprus. E-mail: info@klinikdeutsch.com. Represented by Ana Gómez (Director). Registration number: HE 493224 (Cyprus). Hereinafter, “KlinikDeutsch”.

(2) These terms apply to contracts concluded by consumers with KlinikDeutsch. A consumer is a natural person who enters into a legal transaction for purposes predominantly outside their trade or self-employed professional activity.

§ 2 Subject matter and services

(1) KlinikDeutsch offers digital German courses, professional-language courses for healthcare professions, online one-to-one lessons and individual VIP programmes.

(2) For digital courses and separately booked lessons, the services and duration are set out in the booking description. For VIP programmes, the accepted personal offer and § 4b apply. Digital courses include the described learning materials, exercises and interactive corrections. One-to-one lessons may be booked as a separate service; in a VIP programme, the agreed lessons form part of the personal offer.

(3) You receive the agreed services online through the digital classroom and, for personal lessons or support, through video conferencing and the agreed contact channels.

(4) Digital courses purchased with a one-off payment have the access period stated in the booking description; where specified, this is 12 months from activation. Access under digital monthly subscriptions is governed by § 4a. Digital access included in a VIP programme is available throughout the programme period agreed under § 4b.

(5) The VIP programme combines the services listed in the personal offer, such as one-to-one lessons, learning planning, personal support and digital course access. Its content, scope and duration are recorded in text form before booking. Its duration and termination are governed by § 4b.

§ 3 Contract formation and booking steps

(1) The website describes the available offers. Contract formation through the online checkout is governed by paragraphs 2 and 3; the personal VIP offer is governed by paragraph 6.

(2) By completing the online booking process and clicking the final button, such as “Book with an obligation to pay”, the customer submits a binding contractual offer.

(3) A contract booked through the online checkout is concluded when KlinikDeutsch confirms acceptance by e-mail or activates access to the content. An acknowledgement of receipt of the order alone does not constitute acceptance.

(4) The contractual language is German. The contract text is stored and sent to the customer by e-mail together with the terms and withdrawal information.

(5) Joining a waiting list or making a non-binding place reservation is free and creates neither an entitlement to a place nor mutual performance obligations. A contract is concluded through a subsequent regular booking.

(6) Before accepting a VIP programme, you receive the personal offer, these terms and withdrawal information. The contract is concluded through the agreed acceptance of the offer; the confirmation contains the agreed services, dates and payment terms.

§ 4 Prices, taxes and payment

(1) Digital courses and separately booked lessons are charged at the prices stated when booking. For VIP programmes, the total price and payment terms in the accepted personal offer apply. All prices are final prices.

(2) Final prices include legally applicable taxes. Tax treatment depends on the agreed service and applicable rules; the invoice sets out the relevant details.

(3) The payment methods shown during online booking are available, such as card payment through the displayed payment provider.

(4) Activation and the start of services are governed by the booking or accepted personal offer and its agreed payment terms.

§ 4a Digital monthly subscriptions: duration and cancellation

(1) Digital courses and trainers booked independently as monthly subscriptions begin with one billing month from activation. Continuation and cancellation are governed by the following paragraphs. Digital access included in a VIP programme is governed by § 4b.

(2) After the first billing month, the digital subscription continues for an indefinite period. Billing is monthly through the selected payment provider. You may cancel at any time with effect at the end of the current billing month.

(3) The customer may give notice of cancellation at any time; it takes effect at the end of the current billing month. The customer’s declaration is sufficient.

(4) You may use the “Cancel my subscription” link in the website footer, which leads to the form without login (§ 312k BGB), e-mail info@klinikdeutsch.com or send a letter to the address in § 1.

(5) KlinikDeutsch promptly confirms receipt by e-mail. The confirmation states the content of the cancellation, the date and time of receipt and the end date.

(6) Full access to the booked content continues until cancellation takes effect. Payments already made for the current billing month cover that month.

(7) KlinikDeutsch may also cancel at the end of the current billing month. If it discontinues a course, it either fulfils the paid period in full or refunds the corresponding portion.

(8) Both parties retain the right to terminate for good cause. For KlinikDeutsch, this may include sharing login credentials with third parties contrary to § 5 paragraph 2.

(9) Courses purchased with a one-off payment expire automatically at the end of their stated access period. The withdrawal right under § 6 remains applicable to both models.

(10) The practice package for practices, medical centres and laboratories is a business monthly subscription. The terms for companies apply.

§ 4b Individual VIP programme: duration, payments and termination

(1) You receive a personal offer specifying the services. It sets out the programme start and end dates, the scope of one-to-one lessons and personal support, included digital access and the total price with payment dates. The duration is determined by your learning goal and the accepted offer.

(2) The programme runs for the period in the accepted personal offer and ends on the agreed date. Any continuation is jointly agreed in text form. The digital course access agreed within the VIP programme is included in its price and available throughout the agreed programme period.

(3) Agreed instalments are parts of the total price set out for the VIP programme. The duration and payment dates are stated in the accepted offer. Changes to scope, duration or payment schedule are jointly agreed and confirmed in text form.

(4) Lesson and meeting appointments are agreed with KlinikDeutsch. To request a change, use the agreed contact channel; mutually agreed replacement appointments are confirmed. Appointments moved by KlinikDeutsch are compensated through an agreed replacement appointment or a corresponding credit or refund.

(5) The total price relates to the services and their provision during the agreed programme period. They remain available as set out in the personal offer. To request a pause or early termination, notify us in text form. We confirm receipt and explain the effective date and settlement. Following a valid early termination, services already provided and any refunds are settled under the applicable statutory rules.

(6) Your withdrawal right under § 6 and statutory early-termination rights remain in force. These include termination for good cause and other statutory rights where their conditions apply. Advance payments for later service periods are taken into account under the applicable law following valid termination.

(7) You may use the contact channels in § 4a paragraph 4 to give notice of termination. KlinikDeutsch confirms your declaration in text form and states the effective end date. Digital access included in the VIP programme follows its agreed period and the effective termination date of the VIP contract.

§ 5 Classroom access and user obligations

(1) Content is accessed through a personal password-protected account on the platform used by KlinikDeutsch.

(2) The customer must keep their login credentials confidential and protect them from third-party access. Access is personal and may not be transferred or shared.

(3) KlinikDeutsch may suspend access temporarily or permanently where there is reasonable suspicion of misuse or sharing of login credentials with third parties.

§ 6 Consumer withdrawal rights

Withdrawal notice

You have the right to withdraw from this contract within fourteen days without giving a reason. The withdrawal period is fourteen days from the date the contract is concluded.

To exercise this right, inform Lernes Ltd, Filias 9, 8220 Paphos, Cyprus, e-mail info@klinikdeutsch.com, through an unequivocal statement, such as a letter or e-mail. You may use the model form below, which is optional.

To meet the deadline, it is sufficient to send your withdrawal statement before the period expires.

Effects of withdrawal

If you withdraw, we reimburse all payments received without undue delay and no later than fourteen days after receiving your statement. We use the same payment method unless expressly agreed otherwise; you incur no fees for the reimbursement.

Starting personal services during the withdrawal period

You may expressly request that lessons or personal support begin before the withdrawal period ends. If you then validly withdraw, proportionate compensation for services already provided is payable only when the statutory requirements are met, particularly an express request for early performance and proper information. It is calculated by comparing the services provided with the total contractual scope.

Early expiry of the withdrawal right

For digital content supplied without a physical medium, the right expires early when KlinikDeutsch starts performance after the consumer (1) expressly consents to performance before the withdrawal period expires, (2) acknowledges that the right is lost when performance starts, and (3) receives the legally required contract confirmation.

For services, such as one-to-one lessons and personal support, the right expires early upon complete performance if, before performance begins, the consumer expressly consents to the start and acknowledges that the right expires upon full contractual performance.

For VIP programmes, the requirements for digital content and personal support are considered separately. Personal services follow the requirements for services, including complete performance and the legally required consumer declarations.

Model withdrawal form

If you wish to withdraw, you may complete and send this form:

§ 7 Usage rights and copyright

(1) KlinikDeutsch content, videos, texts, software, graphics and tasks are protected by copyright.

(2) The customer receives a non-exclusive, non-transferable right of use limited to the agreed course period for their own learning, including personal professional development.

(3) Any additional use, particularly reproduction, distribution, commercial exploitation, public access or sharing with third parties, including excerpts, requires KlinikDeutsch’s express written consent.

(4) Course data protection: use fictional or fully anonymised case details in practice texts, simulations and corrections. This protects the identity and personal health data of real patients.

§ 8 Technical requirements and availability

(1) The customer provides the necessary technical equipment at their own expense: a stable connection, an up-to-date browser, microphone and speakers, and a camera for agreed lessons or personal video meetings.

(2) KlinikDeutsch operates and maintains the platform for the agreed use. For technical issues, contact info@klinikdeutsch.com. Statutory rights concerning defects or performance issues and the liability provisions in § 10 remain applicable.

§ 9 Agreed services and learning goals

(1) KlinikDeutsch provides the agreed teaching, learning and support services. For VIP programmes, the scope of the accepted personal offer applies.

(2) These services develop your German and prepare you for your professional goal. Progress also depends on your prior knowledge, practice and participation. Examination results, qualification recognition and professional authorisation are decided by the responsible bodies.

§ 10 Liability provisions

(1) KlinikDeutsch is liable without limitation for injury to life, body or health and for intent, gross negligence or fraud.

(2) For breaches of essential contractual obligations caused by ordinary negligence, liability is limited to foreseeable loss typical of the contract.

(3) Further liability is excluded, while liability under mandatory statutory rules, such as product liability, remains unaffected.

§ 11 Contract terms and changes

(1) The terms incorporated when the contract is concluded and the accepted offer apply. Individually agreed contractual terms take precedence over these general terms.

(2) Changes to an existing contract are jointly agreed and documented in text form. Express consent is obtained where required. Legally permitted adjustments follow their applicable statutory conditions.

§ 12 Final provisions

(1) The law of the Republic of Cyprus applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

(2) For consumers, this choice applies insofar as it preserves mandatory protection under the law of their country of habitual residence, in accordance with Article 6 paragraph 2 of the Rome I Regulation.

(3) Consumer dispute resolution: contact KlinikDeutsch through the channels in § 1. KlinikDeutsch is neither willing nor obliged to participate in proceedings before a consumer dispute resolution body.

(4) If any provision is invalid or unenforceable, the remaining provisions remain valid.
